1. Use of this website
This website is operated by KO Technologies, an Irish software business. By using it, you agree to these terms. If you do not agree with them, please do not use the website.
You may use this website for lawful purposes only, and must not attempt to interfere with its operation, security or availability.
2. Website content
The content on this website describes KO Technologies, KitchenOps and the way KitchenOps is intended to be used. It is provided for general information.
Interface previews shown on this website are illustrative. They use generic sample data, do not represent any customer's configuration, and are not a commitment that a given screen or feature will be identical in any particular deployment.
We describe the product as it stands and as we intend it to develop. Descriptions of preparation for pilot deployment are statements of status, not guarantees of a delivery date, and are not a commitment to make any specific functionality generally available.
3. Intellectual property
The KO Technologies and KitchenOps names, logos, product design, text and other content on this website are owned by KO Technologies or used with permission. You may view and print pages for evaluation and internal purposes. You may not copy, reproduce, modify or redistribute them for commercial purposes without our written permission.
4. KitchenOps pilot and evaluation access
- Access to KitchenOps during the pilot and evaluation stage is provided for evaluation and operational use by the participating organisation.
- Features, configuration and performance may change during this stage as the product develops. Functionality may be added, altered or withdrawn.
- Continued availability is not guaranteed during the pilot stage. We will communicate material changes to the organisations involved.
- Access must not be resold, sublicensed or provided to third parties without our written agreement.
5. Operational responsibility
KitchenOps is operational support software. It generates and displays operational information based on the data it is given.
It is not a substitute for professional judgement in meal production, allergen management or food safety, and it does not remove responsibility for those matters from the operating organisation. Generated output — production lists, packing and label information, dispatch records, routes and delivery records — should be reviewed before use in a live service.
6. Your data and your obligations
- You are responsible for ensuring that data loaded into KitchenOps is accurate and complete, and that you have a lawful basis to process it.
- KitchenOps processes data as provided. It does not validate the correctness of source information, and it does not verify that the source system is correct.
- Where personal data relating to pupils is involved, the operating organisation is the data controller and is responsible for meeting its obligations under the GDPR. KO Technologies acts as a data processor. See the privacy page for detail.
- You are responsible for maintaining the security of access credentials and for the roles and permissions granted to your users.
7. Availability
We aim to keep KitchenOps available and reliable during operational hours, but during the pilot stage it is provided without a service level agreement. Where KitchenOps is deployed on the operating organisation's own infrastructure, availability depends on that infrastructure.
8. Liability
Nothing in these terms excludes or limits liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the fullest extent permitted by law: this website is provided on an "as is" basis; we do not warrant that it will be uninterrupted or error-free; and we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss arising from operational decisions taken on the basis of generated output that was not reviewed.
Formal liability provisions, including any agreed caps, will be set out in the commercial agreement entered into before commercial rollout.
9. Suspension and termination
We may suspend or withdraw access to KitchenOps where these terms are materially breached, or where continuing access would create a security, legal or operational risk. Where practical, we will give notice and an opportunity to resolve the issue.
10. Governing law
These terms are governed by the laws of Ireland, and the Irish courts have exclusive jurisdiction over any dispute arising from them or from use of this website.
11. Changes to these terms
We may update these terms as the product and the company develop. The date at the top of this page will change when we do. Terms in force at the time you use the website or the product are the ones that apply.
